     The Senate met at 11 a.m.

     Debra Renee Burkhardt, London, West Virginia, proceeded in the singing of "The Lord's Prayer", accompanied by Larry Cole, Choral Director, West Virginia University Institute of Technology, Montgomery, West Virginia.
     Pending the reading of the Journal of Thursday, January 30, 2003,
     On motion of Senator McCabe, the Journal was approved and the further reading thereof dispensed with.
     The Senate proceeded to the second order of business and the introduction of guests.
     The Senate then proceeded to the third order of business.
     A message from The Clerk of the House of Delegates announced the passage by that body, to take effect July 1, 2003, and requested the concurrence of the Senate in the passage of
     Eng. Com. Sub. for House Bill No. 2155--A Bill to amend and reenact section three, article one-a, chapter eighteen-b of the code of West Virginia, one thousand nine hundred thirty-one, as amended; and to amend and reenact section one, article ten of said chapter, all relating to higher education; tuition and fees; peer institutions; adjustments to peer institutions; and limitations on tuition and fee increases.
     Referred to the Committee on Education; and then to the Committee on Finance.
     The Senate proceeded to the fourth order of business.
     Senator Prezioso, from the Committee on Health and Human Resources, submitted the following report, which was received:
     Your Committee on Health and Human Resources has had under consideration
     Senate Bill No. 272, Authorizing department of health and human resources to promulgate legislative rule relating to nurse aid abuse registry.
     And,
     Senate Bill No. 275, Authorizing division of health to promulgate legislative rule relating to surrogates for incapacitated persons in health care facilities operated by department of health and human resources.
     And reports the same back with the recommendation that they each do pass; but under the original double committee references first be referred to the Committee on the Judiciary.

     And reports the same back with the recommendation that they each do pass; but under the original triple committee references first be referred to the Committee on Finance; and then to the Committee on the Judiciary.

-A Bill to amend and reenact section seven, article one, chapter eleven-a of the code of West Virginia, one thousand nine hundred thirty-one, as amended; and to amend and reenact section twenty, article three of said chapter, all relating to real and personal property taxes; sheriff's tax on sale of real estate erroneously assessed or nonexistent; modifying the method for a purchaser to recover the purchase money; limiting the period of time for demanding a refund; and requiring that delinquent personal property taxes, just as real estate taxes, must be paid before current taxes may be paid.
     Referred to the Committee on the Judiciary; and then to the Committee on Finance.

     Senator White presented a petition from Bryan Jordan and numerous West Virginia residents, requesting the Legislature to reform the medical liability system.

     The Senate again proceeded to the twelfth order of business.
